Terms of Service

1. Acceptance of Terms

By accessing or using Cykanner's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Service

Cykanner provides breach monitoring services that check email addresses against known data breaches and alert users when their credentials may have been compromised.

3. Account Registration

To use our services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Be at least 18 years old or have legal authority to bind your organization

4. Domain Verification

You must verify ownership of any domain you wish to monitor. You represent and warrant that you have the authority to monitor email addresses on domains you add to our service.

5. Acceptable Use

You agree not to:

  • Monitor email addresses without proper authorization
  • Use the service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service
  • Resell or redistribute the service without authorization

6. Billing and Payment

Our services are billed at $7 per monitored user per month, or $70 per monitored user per year if you choose annual billing. A "monitored user" is an active monitored email address -- disabling an address (from your dashboard or via the API) stops it counting toward your bill. A subscribed organization is always billed for at least one monitored user, even with zero active monitored email addresses. By subscribing, you:

  • Authorize us to charge your payment method
  • Agree to automatic renewal at the end of each billing period (monthly or annual, matching your selected plan) unless canceled
  • Are responsible for all applicable taxes

7. Free Trial

We offer a 14-day free trial. No credit card is required to start. At the end of the trial, you must add a payment method to continue using the service.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability with reasonable notice when possible.

9. Intellectual Property

We own the Cykanner service, including its software, design, and branding. We grant you a limited, non-exclusive, non-transferable right to use the service for your organization's own internal purposes, subject to these terms. You retain ownership of the data you submit to the service (e.g. your monitored email addresses and organization details) — we use it only as described in our Privacy Policy to provide the service to you.

10. Limitation of Liability

Our service provides information about potential breaches but cannot guarantee complete detection of all breaches. We are not liable for:

  • Damages resulting from undetected breaches
  • Indirect, incidental, or consequential damages
  • Loss of data or business interruption

To the maximum extent permitted by law, our total liability arising from or relating to these terms or the service is limited to the amount you paid us for the service in the 12 months before the claim arose.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these terms, your misuse of the service, or your violation of any law or third party's rights — including monitoring email addresses without proper authorization.

12. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the service will cease and your data will be deleted according to our retention policy (see our Privacy Policy 's Data Retention section) — or immediately, if you use self-service account deletion.

13. Dispute Resolution

If a dispute arises, we encourage you to contact us first (see below) so we can try to resolve it informally. If we can't resolve a dispute informally, it will be handled under the Governing Law section below.

14. Governing Law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any disputes will be resolved in the state or federal courts located in Wyoming.

15. Severability

If any provision of these terms is found unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

16. Entire Agreement; Waiver; Assignment

These terms (together with our Privacy Policy and, where applicable, our Data Processing Agreement — which applies automatically to the extent we process personal data on your behalf, whether or not a separate copy has been countersigned) constitute the entire agreement between you and us regarding the service. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign or transfer these terms without our written consent; we may assign these terms in connection with a merger, acquisition, or sale of assets.

17. Force Majeure

Neither party is liable for delays or failures caused by events outside its reasonable control, including natural disasters, internet or infrastructure outages, or acts of government.

18. Changes to Terms

We may modify these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.

19. Children

Cykanner is a business-to-business service intended for use by adults. It is not directed at children, and you must be at least 18 years old (or have legal authority to bind your organization) to use it — see Account Registration above.
